The purpose of this role is to:

• investigate and manage potential and actual clinical negligence, Employer's and Public Liability and Property Expenses scheme claims against the Trust, and other occasional small claims, according to the Trust's Claims Policy and in line with statutory requirements and NHS Litigation Authority rules.

• to analyse trends and provide management information (risk management feedback, themes and financial costing) to Directorates and to the Trust on claims received to enable the organisation to understand its claims liability and to improve systems as appropriate to enhance the safety of patients, staff and other stakeholders.

The post holder will act as an in house expert in the primary assessment of the Trust's liability for clinical negligence claims in terms of breach of duty, causation and estimation of quantum, knowing when to draw upon specific expertise from specialty based senior clinicians. They are expected to manage clinical negligence, employers and public liability claims autonomously, liaising with the NHSLA and panel solicitors when required and in accordance with NHSLA scheme rules, and to provide support and advice to the Legal Services Manager. They require the ability to recognise own limitations and to know when to escalate the situation for qualified legal advice.

The post holder will normally be based on one site but may require cross site and community-based working from time to time.

Knowledge & Skills

* Excellent English spelling and grammar including the ability to be clear and concise in written English (eg: drafting formal letters and reports), and excellent attention to detail

* Advanced computer skills in word processing and spreadsheets, experience of using databases

* Excellent skills in analysing data, identifying trends and compiling reports, communicating these to relevant individuals within the Trust

* Demonstrable ability to assess and make effective decisions under pressure in complex situations

* Ability to take decisions with sound judgment about reporting / escalating significant issues to seniors

* Demonstrable leadership and communication skills with proven record of managing and working as part of a team

* Demonstrable evidence of project management experience and delivery of objectives

* Ability to work independently and to meet deadlines

* Ability to prioritise and manage time effectively and efficiently
