We are APS Legal & Associates, part of the SimplyBiz Group. We are a leading provider of estate planning and will writing services.

We are currently recruiting for a Probate Case Manager to join us on a full time, permanent basis, based at our office in Worksop.

Reporting to the Probate Manager, the Probate Case Manager will complete estate administrations following the legal requirements of the Administration of Estates Act and the Trustees Act. This includes full administration of taxable and non-taxable estates, setting up trusts and deeds of variation.

Key responsibilities:
  • Communicating and maintaining a relationship with clients and associates via letter, email, and telephone.
  • Collect relevant financial information in order for our solicitor to submit the probate application.
  • Liaise with solicitors in relation to the probate application and HM Revenue & Customs queries on taxable estates.
  • Collection or transfer of assets to the beneficiaries.
  • Handle the transfer or sale of the deceased property, to include liaise with estate agents, solicitors and Executors.
  • Have a full understanding of the administration of trust-based Wills including nil rate band trusts and interest in possession trusts. To also understand the tax consequences of these trusts.
  • Complete and submit relevant income tax returns.
  • Reconcile Executor accounts.
  • Draft and complete estate accounts, reconciled to the Executor account.
  • Obtain Executor approval of estate accounts.
  • Make adequate searches in order to settle the estate upon completion of the administration.

Key competencies required for the role:
  • Communication skills - internal and external written, telephone and face-to-face communication to clients, beneficiaries and internal departments.
  • Customer service - both internal and external to include solicitors, HM Revenue & Customs, financial institutions and the Land Registry. Rapport building, listening and interpretation, fact finding, understanding needs and negotiation. Maintains positive internal relationships.
  • Time and self-management - organisation and prioritisation, working to deadline, taking ownership and accountability for own area.
  • IT skills - Word, advanced Excel and basic PowerPoint. Accounts packages where required together with appropriate case management systems.
  • Change management - recognise the need for change and the impacts of change to both the individual and the team. Be able to communicate the requirements for change and maintain ongoing communications on implementation and delivery. Be able to work with staff to understand their concerns and issues and recognise and implement relevant and appropriate support.
  • Legal understanding and processes - a solid understanding of the legal requirements of administering an estate and paperwork needed to make an application to the Probate Registry, to include all relevant HM Revenue & Customs forms both the IHT205 and IHT400. Understand and complete all relevant income tax forms applicable to estate administration. To administer an estate from beginning to end, including collecting assets, settling liabilities and distributing estates.To understand the rules of intestacy and have the ability to administer cases under the intestacy rules following correct procedures. To understand how to set up trust-based wills including nil rate band trusts, interest in possession trusts and discretionary trusts. To understand the requirements of creating these trusts and the tax consequences.

Experience and qualifications:
  • Previous experience in the administration of estates both taxable and non-taxable, simple and trust based.
  • Experience in managing a full case load of files.
  • Previous experience in drafting Wills and Trusts.
  • Experience communicating with clients and third parties.
  • Preferably STEP or CILEX qualified or working towards the qualification.
