Capita are the preferred recruitment supplier for a leading Regulator who are expanding and leading the way as an independent body. We are looking to recruit a Senior Legal Advisor to work as a member of the Legal team responsible for the provision of litigation and regulatory advice
The job holder will have responsibility for managing the organisation's defence of statutory appeals at magistrates' courts including case management and conducting advocacy in courts across England & Wales.
Duties will include:
Responsibility for advising on the organisations criminal prosecutions, including considering investigation papers, advising on whether prosecutions should be undertaken, preparing cases for trial, instructing counsel and liaising with defence solicitors
Delivering high quality and timely advice on all other legal matters arising, including public law, corporate law and regulatory law matters
Providing advice on the Private Security Industry Act 2001, making recommendations for legislative amendment where necessary
Providing advice to the Executive Team and the Board on UK and European legislation as required to ensure compliance and inform strategic direction and risk management
Drafting correspondence for the Chief Executive/on behalf of the organisation where required
Candidates applying will be a solicitor or barrister with extensive post qualification experience qualified in England and Wales with current practising certificate. Experience in criminal and regulatory law work, including advising on prosecutions is also required. The successful candidate will be responsible for the defence of statutory appeals against the regulatory decisions. Where the organisation refuses, revokes or suspends an individual licence, or refuses or withdraws Approved Contractor status, the successful candidate will oversee the organisations conduct of the statutory appeals against those decisions. This involves advising the Decisions Team, overseeing the work of paralegals, liaising with appellants and their lawyers, preparing cases for hearings, and undertaking advocacy in the magistrates' court. They defend appeals at courts across the UK, and so some travel will be required.
In addition, the successful candidate will have the opportunity to become involved in other areas covered by the in-house legal team, including criminal prosecutions (including POCA proceedings), employment issues, and contractual matters.
