We are looking for a highly motivated and enthusiastic individual to join the Mental Health Act Administration Team based at Cygnet Hospital Coventry. The post holder will work within a small team who are responsible for the day to day administration of the Mental Health Act 1983.

Applicants will be expected to provide excellent clerical and administrative support within the team and to effectively manage their own caseload of service users.

This will include scrutiny of legal documents, rectification of documents, the monitoring of spread sheets to ensure legal documents are received in relation to treatment and renewal of detention. They will provide assurance that patients’ rights under Section 132 are adhered to and be responsible to arrange patient’s hearings, if they appeal to the Mental Health Tribunal or Hospital Managers.

Applicants will be required to use their own initiative to manage and prioritise their own caseloads. They must be a team player, meet tight deadlines, able to adjust plans accordingly without warning and possess excellent communication skills.

Applicants must possess knowledge of the Mental Health Act and Mental Capacity Act to enable them to administer the Act and provide relevant information to clinical staff.

To provide a high level of clerical and administrative support to ensure that the legal requirements of the Mental Health Act 1983, Mental Capacity Act 2005 and Deprivation of Liberty Safeguards are adhered to.

The post holder will need to understand Mental Health Act legislation.

Key Performance Areas

To scrutinize and process legal documentation regarding patients detained under the Mental Health Act 1983.

To ensure that all reports for Mental Health Review Tribunals and Hospital Manager meetings are requested from professionals internally and externally and collected/distributed in a timely manner.

To deal with the administrative tasks associated with Managers Hearings and Mental Health Tribunals including meeting with detained patients to explain their rights of appeal against detention under the 1983 Mental Health Act.

To liaise with the Mental Health Tribunal and Ministry of Justice with regard to agreeing dates for Tribunals.

To book rooms and interpreters for Mental Health Tribunals and Hospital Manager hearings as required.

To arrange Hospital Manager Appeals/Section renewal meetings and to provide support and a clerking service to the hospital managers’ panel as required.

To ensure that all legal documentation is correct and available to go with a patient when transferred to other Services/Hospitals.

To collate and update systems with regard to relevant patient notes, records and legal documents and maintain Mental Health Act databases and other Hospital databases, E-Systems as required.

To be responsible for liaising with the relevant professionals, internal and external regarding requesting visits from Second Opinion Appointed Doctors

To provide information to patients and their relatives in accordance with the Mental Health Act Legislation.

To remind and follow up Responsible Clinicians about the expiry of sections.

To deal with the administration of Consent to Treatment Regulations.

To assist in the administrative tasks associated with Care Quality Commission visits.

To ensure adequate stocks of Mental Health Act stationery are maintained at all times.

To participate in on-going audits and service development within the team.

To support with Subject Access Requests and archiving of MHA records as required.

To undertake any other appropriate tasks as requested by the MHA Senior or Administration Manager to meet the needs of the service.

To work on projects as allocated.

To undertake any training currently required for the role and for the future development of the role and department.
